Terms of Service

This Terms of Service is made and entered into by and between Network Technical System Co., Ltd., operating under the brand name hostatom (“hostatom”), and any individual or entity accessing or using the Services (the “Customer”, “User”, or “your”). All references in this Terms of Service to the “hostatom” shall be deemed to refer to Network Technical System Co., Ltd. All references to the “Customer”, “User”, or “your” shall be deemed to refer to the individual or entity using the Services (the “Services”). This Terms of Service governs the rights and obligations of the parties in connection with the use of the Services. Capitalized terms used herein shall have the meanings assigned to them in this document unless the context otherwise requires. By accessing or using the Services, the Customer acknowledges and agrees to be legally bound by the terms and conditions set forth herein.

1. Disallowed Website Types

1.1 hostatom does not provide Services to websites or activities of the following nature:

  • Websites containing content that attacks, defames, or undermines the security of the monarchy or religion, or that incites unrest, causes harm to others, or contains pornographic or obscene material.
  • Gambling websites.
  • Websites providing BitTorrent services, trackers, online streaming, pirated software, cracks, hacks, warez, or the distribution of viruses, worms, or trojans, including the use of servers to attack other servers (such as mail bombs, hack attacks, spamming, port scanning, or port probing).
  • Websites that send spam emails (bulk emails without the recipient’s consent) or post to newsgroups using spoofed or randomly generated email addresses, such as abc@hotmail.com, john@hotmail.com, or ant@hotmail.com.
  • The distribution of chain messages that generate excessive replies or repetitive messages causing annoyance to others.
  • The use of any program or system for the purpose of sending spam emails.
  • The sending of emails that infringe upon rights, threaten, harass, or otherwise negatively affect others.
  • Websites related to system intrusion, virus dissemination, or activities that are illegal, immoral, or cause public disturbance.
  • Websites utilizing scripts or programs that disrupt server operations, such as excessive use of processing resources or memory.
  • Websites that infringe upon trademarks, copyrights, or intellectual property rights of any person or organization, whether domestic or international.
  • Websites containing threatening, deceptive, false, offensive, or drug-related content.
  • Websites that negatively affect or damage the reputation of hostatom.
  • Websites containing content or engaging in acts that constitute an offense under the Computer Crime Act B.E. 2550 (2007).
  • Any other websites that hostatom considers inappropriate.

1.2 hostatom reserves the right to terminate the agreement or suspend or shut down the website without prior notice and without refund of service fees if the Customer violates these Terms of Service. Determination of such violation shall be at the discretion of hostatom.


2. Accuracy of User Information

The Customer must provide information that is accurate and truthful. If any information is found to be inaccurate or untrue, hostatom reserves the right not to proceed with any request.


3. Domain Names

Domain names cannot be changed after registration. If a new domain name is required, the User must register the new domain name and pay the applicable registration fees.


4. Service Activation

Services will be activated within 24 hours on a Business Day after hostatom has received complete proof of payment.

If essential information is missing, such as the order number, domain name, or contact number, or if there has been no communication for more than 30 days, the order will be canceled.


5. Refund Policy

The Customer may request a refund within 30 days from the date of service activation. hostatom will issue refunds only for the Services eligible under the applicable policy, provided there has been no violation of these Terms of Service.

hostatom will deduct the following applicable fees before issuing the refund:

  • Currency exchange fees (in the case of payments made in foreign currencies).
  • Transfer fees or payment processing fees incurred through credit card payments or other payment channels.

hostatom may designate certain Services as non-refundable.

6. Service Expiration Notification and Post-Expiration Data Management

To ensure continuity of service and prevent data loss, hostatom’s system will provide notification of service expiration and manage data in accordance with the following details:

6.1 Service Expiration Notification

The system will notify Customers when the Service is approaching its expiration date through the registered communication channels (e.g., email or the member system). Notification details are categorized by Service type as follows:

6.1.1 Web Hosting and Domain Name Services

  • Notification 30 days in advance.
  • A subsequent notification 7 days prior to the expiration date.

6.1.2 Cloud VPS, Private Hosting, and Dedicated Server Services

  • Monthly plans: Notification 7 days in advance.
  • Annual plans: Notification 30 days in advance and a subsequent notification 7 days prior to the expiration date.

6.2 Service Suspension and Data Deletion

6.2.1 If payment is not made by the due date, the system will temporarily suspend the Service.

6.2.2 For Web Hosting and Domain Name Services, data will be retained for 30 days from the expiration date.

6.2.3 For Cloud VPS, Private Hosting, and Dedicated Server Services, data will be retained for 21 days from the expiration date.

Upon expiration of the specified retention period, if the Service has not been renewed, hostatom reserves the right to permanently delete all data from the system. Such data shall not be recoverable in any case.

6.3 Additional Recommendations

For data security and continuity of service, hostatom recommends that the Customers:

  • Regularly review emails or system notifications.
  • Independently back up important data prior to the expiration date.
  • Renew the Service before the due date.
  • Contact hostatom’s support team if there are circumstances that may prevent renewal within the specified period.

7. Limitation of Liability

hostatom shall not be liable for any damages, whether direct or indirect, arising from force majeure events, user error, or technical issues beyond hostatom’s control.

8. Service Suspension

If any suspicious behavior is detected or a complaint is received, hostatom reserves the right to temporarily suspend the Service for investigation without prior notice.


9. Invalid Payments

If the use of a fake credit card or the unauthorized use of a credit card is detected, hostatom will immediately terminate the Service.


10. Personal Information

hostatom may disclose Personal Information with consent or as required under applicable law to its officers, authorized representatives, or government authorities as necessary.

11. Content Copyright

No content, design work, or information created by hostatom may be reused, modified, or distributed without prior written permission.


12. Contact & Identity Verification

hostatom will contact the Customer only via the email address used to place the order on the website. If there is any change in the system administrator or the contact email address, the Customer must notify hostatom using the original email address.

If it is not possible to use the original email address for such notification, hostatom may request additional verification documents, such as a company certificate or receipt.

If such verification documents cannot be provided, hostatom shall not disclose any confidential information to the requester under any circumstances.


13. Consultation Scope

hostatom does not provide website development services or services involving the installation, modification, or troubleshooting of any programs or scripts.

If the Customer has questions in such matters, hostatom may recommend relevant sources of information for the Customer’s independent study.

hostatom will provide assistance with matters related to web hosting and email usage. hostatom’s primary responsibility is to ensure that the server operates in accordance with the scope of services specified on the website.


14. Handling of Files Containing Viruses

If any files stored or used by the Customer on the server, such as website files, emails, or databases, are detected by the system to contain viruses, the system shall automatically delete such files for security purposes, without prior notice.


15. Exceeding Resource Quotas

If the Customer’s usage of storage space, data transfer (traffic), or other system resources exceeds the limits specified in the subscribed package, hostatom reserves the right to temporarily suspend the Service.

The Customer may contact hostatom’s sales department to request an upgrade of the Service package.


16. Service Cancellation or Downgrade

If the Customer cancels or downgrades the Service before the end of the applicable service term, the Customer shall not be entitled to any refund.

An exception applies where hostatom initiates the cancellation of the service, in which case hostatom may consider issuing a refund as deemed appropriate.

17. Backup Requests

For data security purposes, The Customer should regularly back up the data stored on the server independently.

Any backup provided by hostatom shall be carried out in accordance with the conditions applicable to each type of Service and is intended solely to facilitate the provision of Services.

hostatom reserves the right to change, amend, or supplement these Terms of Service without prior notice.
